Build a pond on river overflow creek bottom.

I have some land with a "creek" running through it that fills with water when the river gets really high. I don't mind that. The problem is the water doesn't drain back off of it very well after the river subsides. I call it a creek, but it doesn't really flow.

Can I dig a pond on the lower end of my property to collect the excess water? Then put in a culvert and use the dirt from the pond to build a road across the creek bottom at a more narrow part of the creek bottom ~400 yards from the pond?

I know it can be done, but how do I go about doing this?
- Do I need to contact a state/county person to look at the property and approve a plan?
- Or, do I need to hire a contractor that can navigate the hoops?
