Actually it matters not wether it is legal or not. I don't think it is appropriate to slam someone publicly when you are usually only hearing one side to a story. You can always share information by PM.

One angry customer ( when you may have 100,000 happy customers ) can do some damage on a public forum.

If you are unhappy with a product or service and you cannot get resolution from the manufacturer, there are other avenues to get resolution.

Apparently Woody prefered it to not be posted and if that is the case his wishes should be respected.

So sites like www.kudzu.com where someone can review a person's business should not exist? The person being reviewed has the option to offer a rebuttal whether it be on Kudzu or on GON.

There are many sites where someone can reveiw products, services etc... How is it that these sites are still in business if they are guilty of libel because someone posted a review of their experiences?

I don't think it is so much as what is said, but who said it here. This board has become more and more liberal moderated the last six months and a decline in membership or participation shows that. Every day I read a thread asking the opinion of a certain weapon or what is the best "____" to buy. If we cannot freely say our opinions of what is bad, then nothing good should be allowed to be said either.

Advertisement is advertisement, be it good or bad. So are we to do away with all of it?

Advertising is not allowed so we most definitely should not say anything good about a product or service.:D

That is absurd and I'd rather you call me a dog than a liberal.

They are public figures. Your opinion can not cause them a monetary loss.

Here's another take on it, someone who feels wronged can file suit, subpoenas are served to the forum owner and management, attorneys have to be hired and days away from our day jobs have to be taken to protect us from personal loss for something a wing nut on here said. That isn't a risk I'm willing to take because one of you didn't get references & do you due diligence before spending your money.

She is a public figure. People didn't say she was a crook they said she was fat and eats unwisely.

and that can't hurt her business? Anybody who owns a business is a public figgure to a degree. They have an image to portray and uphold. If they don't...we have a right to express our disgust in any matter we with. My opinion is not your responsibility. Peace...I'm out

I guess today was our lucky day!

Yes I do believe that, management is called to court whether founded or not founded. That means I have to lose time from work. That means money to me.

you are not the management that would get called in. The shift supervisor at McDonalds is not the one they call to court when Micky D's gets sued. I am SURE that GON has a couple of lawyers that handle this kinda thing

Its still slander, plain and simple!...........I will not argue this with you though. You know as good as I do it is what it is.

It all boils down to its Steve's board and Steve's rules and thats ok......If he can sleep at night knowing fellow outdoorsmen got taken advantage of, I most certainly can I guess.

Have a wonderful rest of your day Delilah :)

Now I will patiently sit back and await some newbie to tell me and others that have been around since the invention of this place to go to greener pastures if we dont like it here.

Until you've personally owned and operated a website / forum it is difficult to understand just how deep the liability goes and how big a lawsuit could get. Thus, in the interest of keeping the site "free" to the members and as "easy" as possible to moderate and maintain you go the route that your software provider wishes you go.

The VBulliten 'Terms of Service' aren't that different from other software / support / forum providers TOS. It is something that the host, Mr. Burch, who is providing this venue, must agree to personally prior to making it available to the membership. These are not GON's rules, these are the Terms of Service by VBulliten that must be adhered to within the Rules set forth by the admin's and moderators of GON.

My suggestion, if you guys think this is so black and white and easy to do, go out and crank up your own outdoors site and #1 see how well you do at getting 70,000 members, then #2 see how much fun it is to manage the few you do get within the TOS of your forum providers software.

Here is a short excerpt from the VBulliten TOS.

vBulletin.com provides you and other users with an opportunity to submit, post, display, transmit and/or exchange information, ideas, opinions, photographs, images, video, creative works or other information, messages, transmissions or material to us, the Forum or others ("Post" or "Postings"). Postings do not reflect our views; and we have no obligation to monitor, edit, or review any Postings on the Forum. We assume no responsibility or liability arising from the content of any such Postings nor for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information within such Postings on this Site or the Forum. You are strictly prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law.

Without limiting the foregoing, the following behaviors are strictly prohibited:

Strong, vulgar, obscene or otherwise harmful language

Racially, ethnically or otherwise, objectionable language

Harassing, intimidating, stalking or threatening other
community members

Libelous, defamatory or otherwise tortuous language

Online vandalism

Impersonation of another person or persons

Posting, distributing, transmitting or promoting illegal content

Invasion of another’s privacy

Actions that are hurtful or harmful to minors

Posting, providing, transmitting or otherwise making available any materials or information infringing on the rights of a third party

Posting, providing, transmitting or otherwise making available any junk mail or spam

Posting, uploading, emailing or otherwise transmitting any material that contains any malicious computer code, or reverse engineering or hacking any materials on this Site.

Yeap....Mr Burch's board and yes, the question was asked of Mr Burch.....So really none of our opinions or answers matter not even the admins and mods thoughts on this matter in the grand scheme of things.

But I sure would like to hear what Mr Burch thinks and has to say, not what an Admin or Mod wants to tell me Mr Burch thinks.
