Workmans Comp Question

As alot of you know,my wife was injured on the job back in April of this year.She had surgery on her shoulder in June.Ever since she has been out of work she has got a check once a week up until a few weeks back.she would miss a week and call them and they would send her money.but now they are doing it on a regular basis.the checks are not there when they are supposed to be.this is getting very annoying.My question is this.Are they trying to sweat her into going back to work she saw a specialist and he is wanting to operate again because the other Dr.messed up.Do you think i/we need to call a lawyer?Has anyone had this kind of problem themselves?I sure would appreciate any kind of help on this.

mikel, I'm not an expert on Workman's comp, or the law

nor do I know all of the facts in your case, but I would feel safe to advise you that it sure would not hurt to seek legal advice. :)

I do feel sure that "they" have consulted an attorney on their rights :)

The last few years of my working, I noticed a distinct change in my employers attitude concerning workers comp.

Mike, contact the HR rep that is in charge of workmans comp. If they do not take care of it with one call, let them know that you are prepared to seek legal council. You can do this with a call or with a written letter. It should be taken care of with a call, since the employer pays workers comp insurance, they want to get the most bang for their buck. Hope this helps, and don't be afraid to put your foot down. They are required by law to have the check to you within a certain amount of time. I can let you know the timeframe on Monday if I am reminded.

PS I am no expert on this, But I did stay at a Holiday in once. :bounce: :bounce:
